Whom Does A Manhattan Business Litigation Law Firm Represent?
A Manhattan business litigation law firm represents both corporate entities and individuals in civil and commercial litigation.
Most civil and commercial claims fall into one of three categories: breach of contract actions, business torts, and statutory claims.
A breach of contract action arises when there is an agreement between the plaintiff and the defendant. The plaintiff alleges that the defendant has breached (that is, violated) the contract. The plaintiff seeks either money damages or specific performance of the agreement.
Business torts claims are judicially created courses of action that are based on neither a contract nor a statute. Examples of business torts are breaches of fiduciary duty, breach of implied covenant of good faith and fair dealing, conversion, fraud, interference with contract, interference with prospective advantage, negligent misrepresentation, and unjust enrichment.
Statutory claims are claims that the state legislature creates by enacting a particular statute. Examples of statutory claims are causes of action under Manhattan General Business Law § 349 and under the New Jersey Consumer Fraud Act.
Some of the categories of corporate clients that I’ve represented recently in litigation are a motor carrier, a cosmetics company, a technology hardware company, a private tutoring agency, a mobile phone dealer, several restaurants, a moving company, a commercial and residential solar development company, a property insurer, several car and limousine services, a staffing agency, an investment advisory and project development firm, a luxury motor vehicle reseller, a bank, an industrial company, a medical practice, a customs plastics manufacturer, a museum tour guide company, a retail wine store, a pharmaceutical company, a cannabis manufacturer, a scrap metal reseller, and a commercial lender. Corporate clients in litigation may be engaged in any industry.
